Edit: not sure why that site assumes it's homophobic though. Just seems like some sort of viral marketing to me (apparently being homosexual is still somewhat surprising and shocking in the United States... and no matter where you are, anything even remotely sexual in a family friendly game is sure to get talked about). Exactly. Even if it was an entirely deliberate action on the part of Nintendo (can't imagine it was, though I wouldn't put it past an employee having a laugh), there's nothing to suggest anything negative.

It will probably get released in 6 months with the cover art re-drawn, showing Tingle with an attitude-y one eyebrow raised, with heavy stubble and shading on his face

Not one to defend the yanks (we all know they can be a bit, ahem, conservative when it comes to certain things) but the article quoted at the top o' the page was actually written by an English bloke from North Yorkshire, according to his bio on the thunderbolt games web site.

Although he did say it was spotted by GameFAQers, who were almost certainly yanks. Bugger, my argument is ruined!

Anyyway, having said that, I too anxiously await the Tingle redesign for the States
