How is that one any different to me going out there and creating a sports sim called 'Super Lario Brothers' featuring a pair of female rabbits as the main characters?

Change but a single letter in the name and have your game focus on something completely unrelated to the title and you avoid getting the **** sued out of you by megacorps. Amazement!
