xbox 360 damaged my disc

just purchased Minecraft for xbox 360, but the disc now has a circular scratch all the way around it - after just 20 minutes playing. position of the xbox is vertical, i.e. stood up. anyone know how to prove to MS that the machine damaged the disc, therefore enabling me to get a replacement disc FOC?

When people moved from horizontal to vertical while the console was on.

It could be a scuff in some cases. I think it was said to be an issue way back and people would phone MS for a compensatory copy of Viva Pinata.

It was definitely an issue with certain types of drive. I had two consoles replaced because of it.
