Would this X-Box get banned on XBL?

Hello, I'm after finding out if my machine, in this current state, would be able to get on XBL and stay on without getting banned. I started playing a month ago or something, but after the recent wave of ban tactics i'm a bit uncertain.

    Here's the machine:

    - 2003-made X-Box
    - X-Ecutor 2.3 chip (or whatever Will2003 was using in summer/late 2003)
    - locked 120 HD

    On the hard drive:

    C:
    [Audio]
    [Fonts]
    [Skin]
[Trainers](don't mind getting rid of that, never use it anyway)
    [xboxdashdata.185ead00]
    [XOdash]
    evox.ini
    EvoXDash.xbe
    XBox Book.xtf
    XBox.xtf
    XBoxDash.xbe

    E:
    [Cache]
[Saves] (seems to be a trace of PCSXBox)
[Screenshots] (Like above, for some reason)
    [TData]
    [UData]
    Lock.log

All of the applications (XBMC, Emulators etc.) are in a 110 gig F: Partition.

Basically, this is the default option on the most recent Slayers Autoinstaller release. note that I have NEVER signed up for live (or played Halo 2) beforehand on the machine before all the HD changes, installation of stuff and BIOS guff was done for the machine. I then played SF:AC on live with no worries, until the breakout of bans came about.

So - Is it fit to play on live again, after the recent wave of bannings? is there any minor alterations to be done (REALLY minor, or changes that someone on these lovely forums can guide me to do)? or should I just go to the shops and buy a new one for ?99 specifically for live and move my gamertag over?

Thanks in advance, I'd love to play H2 and SFIII with you lot again ;p

you should be alright, I'm using a chipped xbox on live myself one with the switch to turn the chip off. Give it a try, if it gets banned so be it. Then by a new xbox. Remember its the xbox that gets bannned not the gamertag.

Currently people reckon that as long as you weren't on live around March 2004 and then had it modded then you should be fine.

Having said that milage may vary and I accept no responsibility.

I don't think where you have files stored matters at all... a lot of people I know didn't bother cleaning up their C drive at all and have yet to be banned. (Of course this may change in the future too)
