Is it safe to login to Halo 2 with a modded Xbox after recent H2 anti-cheating patch?

I have a modded Xbox with a larger HDD for homebrew and imports, that has a chip I can turn off, that allows normal Xbox Live play with no problems. However I saw a new Halo 2 "anti cheating" patch was released that Bungie said actually checks for unusual things on your HDD, and then bans you from Halo 2 matchmaking.

Apparently this Halo 2 Xbox Live patch is designed to check for modified Halo 2 savegames on the hard drive. I don't have anything of that nature, I've only ever played Halo 2 "pure" and with the chip off, but I'm worried if I login to Halo 2 now, even though the chip is off, it might detect that I have Mame on my hard disk and interpret it as some kind of modified cheating method and ban me anyway from Halo 2 matchmaking.

If that's the case I'd rather just wait until I get an Xbox 360 and then login to Halo 2 from that. I don't want my gamertag to be banned from Halo 2 by mistake with no way to appeal

Has anyone done something like this already and confirmed the Halo 2 anti-cheating patch doesn't ban you for other stuff on your hard disk? Any info appreciated... thanks

Remember its not your gamertag that gets banned anyway, its the actual Xbox. So, may as well give it a go if you were prepared to wait for the 360!!

I've been using my modded xbox without any probs. It dosen't have a bigger drive, but it does have mame etc on it.
