Broken 360 game in the post

    Hey guys.

Basically, I sold a 360 game to a member of these forums. It arrived on the 17th, and he opened it today.

The game has a little crack down the middle, and scratches on it.

Now, it certainly didn't happen this end, as the game was sent in good condition, certainly not with a crack. And i'm sure it wasn't the guy who i've sent it too.

Only trouble is, it was sent through a post box with stamps on, so I don't have a reciept. I'm guessing this has happened during delivery from the royal mail.

What are my options? Can we claim?

    Cheers
    Scott

Sure you can, even with normal post, think there is a claim form you download on royalmail.com, send that off with a letter stating what's happened and they should sort you out (worked for a friend of mine who sent some kids toys that got damaged), think max claim value on normal post is something like ?27 though.

£27 should be fine, as that was roughly the price of what he paid.

Would it be best for the buyer, or the seller to send off the form and the letter?

      Thanks David.

ive had a similar problem on ebay and the fact is, if it wasnt sent by recorded mail then you don't have a leg to stand on as far as making a claim with the royal mail. You can try and claim but don't expect to get anything back

              Not true.

I've claimed using a certificate of posting before so it doesn't have to be recorded. However, I would suggest always getting a cop.

Despite the lack of one they should still come through with compensation although it might be better to say the item was actually lost rather than damaged.

Certainly the senders responsibility to claim though. I always refund buyer immediately and then wait for Royal Mail to cough up. Again though, not sure how it'll work without a cop.

Discs can crack sometimes on their own, it's weird. My PAL copy of Nights on the Sega Saturn suddenly developed a crack out of nowhere.
