Outside of the potential email issue, doing it in public over ebay would be a bad idea. There would be a chance of microsoft nixing it. Some other things to keep in mind-
If the content license had been transferred to another 360 in the past year.
Banking details attached to the account.
Like with Wii that have VC bits on them. Don't expect anything near what you paid back. It would be dupecity for most people.

I suppose you could try selling to someone on here who you feel you can trust. They could buy the account, do the licence transfer and then use their existing account with the licensed games/etc.
Glad you asked, as I was thinking the same thing, although I've decided to hold on to my 360. It's easy to remove credit cards from your account now, but I just tried removing mine and can't because I used it to pay for this year's live sub so would have to wait for that to expire before I'm able to. One thing I'd be concerned about would be if the person's 360 was stolen/sold on and the account wasn't removed.
Bit of a side question but might help a bit - what if the person did the licence transfer and then deleted your account? They'd still have the games on their 360, wouldn't they? And it would be more secure if something were to go awry down the line. Then they could just reuse the info if they needed to transfer again down the line.
According to this, you can change the associated Windows Live ID on your 360.
In any case, it sounds quite involved so if it were me I definitely wouldn't go near eBay and would stick to this forum(assuming it's allowed on here) or, ideally, someone I know in person.

You can change the account to a new live/hotmail email address thus solving the existing email problem. Bank details are copied over on the billing site but only the type/last 4 digits/name/address are visible on a cancelled cards.

NEVER even consider doing this on ebay or with complete random. Although it isn't the same as sharing accounts it's grey enough to not being suitable for the trading forum.
