Ninja Gaiden 3 for 360 - not loading up. Help please!!

Just purchased a copy from gamestop. Turns up open & the disc was in a little pouch inside the case, so not really 'new' as described

Popped it in the tray, games starts to load, screen goes black, disc is spinning like hell, screen stays black.
I remove from tray & my 360 signs me out, then back in.

Tried several times & installed the game to my HD - same result everytime.

Can anybody help me out on this coz its doing my sven in!!!!!

Have you tried clearing the cache on the hdd?

I just emptied the cache, but still getting the same result I'm afraid
