    shopto.net woes - order not complete & they aint budging

    I bought a GH5 guitar bundle which came with a free GHWT game. It was out of stock so was put on a pre order. It took over a month to come back into stock & arrived end of last wk.

    The free GHWT was missing & in its place was a crappy T-Shirt, so I checked my account & it only showed 'GH5 Bundle', so I phoned them up to say there was an item missing.

    All I got from the staff member was that that particular bundle had ended a while ago & thats why I didnt get the game, & it wasnt in stock so I wouldnt be getting the game.

    I argued with him that the order wasnt complete, that it wasnt what I ordered or as described & that I should have been informed of a change in the description BEFORE it was posted but no way was he budging, so I told him I was returning it for a refund. However he told me that it would be ME that had to pay for the posting of it regardless of the fact that it was THEY that made the mistake.

    Again he wasnt budging so I told him that this wasnt over & I would be seeking further assistance & would phone him back.

    So where do I stand on this & what can I do about it?

    Threaten to give trading standards a call. Once the money was taken, a contract was made. Regardless that it was offered for free, it was still agreed to be provided as part of a sale.

    If it's been less than 7 working days, the distance selling act requires the retailer to accept a return and give you a full refund regardless of why it's being returned. They can't weasel their way out of that.

        Do you have an original invoice email that specifically states what the bundle had?

        To be honest you're covered on so many grounds if they've done this.

          If all else fails get the card company you paid with involved. They'll listen to them.

              I'm sure this will cause the Shopto defence force to rally around after I say this, but stuff like this just one of the reasons I stopped using them.

              They're not even that cheap any more and personally I'd rather pay a few quid extra and use a reputable retailer that isn't going to try and bum you in the gob whenever they get a chance.

                Distance Selling Regs state that you have the right to return an item for whatever reason if you are not happy with for a refund within 7 days. The retailer has the right to make you pay for return of the item, though. If the product description was not correct when bought then it contravenes the Sale of Goods Act as the item was not as described, unless ShopTo had a disclaimer like "Contents Subject to Change" or "Bonus Item Whilst Stocks Last" or something along those lines.

                    I use them when they have genuinely good deals on (They had some great deals on Blu-Rays a few weeks back that covered some Christmas presents), but that's it. I always use Paypal with them as well now, to be on the safe side.

                      I aksed the member of staff why didnt they have some kind of method of informing the buyer if the description had changed before charging them automatically, allowing them to choose whether or not to accept it (like they already have in place should the price increase), but he just said they didnt.

                      So if I want to send it back I'll still have to pay the cost of p&p even though its the sellers fault for not sending my complete order?

                      BTW what can my card company do about it?

                        It's not as described, according to that. The only caveat is if it said that GH:WT was only chucked in for free whilst stocks last on the order page or summat like that. Looking at other retailers, they pretty much all have "Limited availability while stocks last" for the freebie GH:WT.

                          If it was a debit card - feck all.

                          If a credit card ring them and tell them you have ordered goods that haven't been as described plus the delivery charge. You will get a full refund and shopto will then deal with the CC compnay, not you.

                          I buy EVERYTHING online with a CC, espcially holidays. You are covered to the hilt, with a debit card you may as well burn the money and just hope the stuff turns up.
