Difference between upgrading and a new contract (apple iPhone related)

Been waiting for a month for the iPad 2 to arrive in stock at our local orange so we can take part in the ?65 deal where you get an ipad2 and a iPhone 4

They now have the iPad in stock but when we went in they had the phone my partner wanted but when they were processing it they noticed that the phone was new customer only and could give it to her as an upgrade

I've never heard of this before so now we have to wait for a phone to come in stock which is for upgrading customers only and the salesman just get on saying its apple's rules

Is this real or is the shop just trying to meet quotas for new customers, kinda hoping someone in the business can let me know as its been dragging on for a whole now

Any help will be useful as I can't find anything online regarding this

I'm pretty sure my phone company here in Canada (Telus) will only give free iPhones to new customers.
