When it got my LL I put a 32gb card in there before powering on. No issues.

Yeah, fairly sure the 3DS will prompt you if it needs to format an SD card. You might need to go into Settings, Data Management first, but it will definitely complain if it can't save to SD. I think the SD in a new 3DS has Nintendo Letter Box, and maybe a video installed on it? So those might need to be downloaded again if you wanted them, or you could just transfer the contents via PC - they are locked to the console, not to the SD card.
I'd recommend a class 10 or better 32GB, that gave me a 5x speed increase in some situations (generating the image cache for the photo app is one good example). That can be inconsistent though, as other factors can cause the image cache to take longer. I'd guess seek times as well as throughput makes a difference.
The SanDisk Extreme 45mb/s 32GB SD card is ?23 on Amazon, that's the one I went for.

I thought so but I can't see it either so maybe that's not the case. The thing with me though is there seems to be a real obvious broken link for me on the Club Nintendo page that seems to be where people say it is. Scrolling to the next banner on that page gives me just a blank broken banner.
