I'd say there terrible way of dealing with digital purchases is their fault though.

No fair point, I'm quite willing to accept I should have kept the receipt with the rest of the stuff from the box. I was thinking more along the lines of supplying nintendo with my proof of purchase, full police report, and then still having to wait for them to conduct their own investigation. When I spoke to them on the phone today, I was told even if you provide all the evidence it's in no way a done deal that you'll be able to download your games on a new system. Like I said I don't expect Microsoft to resupply my stolen games, so I can't hold it against nintendo. It's just a bit gutting when downloads are so easy to redownload on many systems.

He has his NNID which proves he bought the games and a police report that proves he had a Nintendo 3ds. A receipt provides no more information. It proves that he bought 'a' 3ds at some point; not that the 3ds he had stolen was that specific one and not that the one he bought or was stolen was the one he had downloaded the games onto. Them wanting the receipt is totally unnecessary.

I'm not saying that Nintendo's digital systems couldn't be better, they certainly could, but I doubt many other companies would give refunds without a receipt either.

He's asking for a refund on a digital download that Nintendo know he bought. The receipt is for some hardware that he is not asking for a refund for. When my original PS3 died all my Singstar songs died with it. At the time (possibly still?) you couldn't just go in and re-download songs to a new PS3 because the Singstar songs were tied to both your account and the particular console (due to an oversight), very much like the way Nintendo's system works, but 1 email to Sony and they credited my PSN account with funds that covered the amount I'd spent on Singstar songs (about ?70). Nintendo could definitely do better.

Absolutely agree, whether you have the receipt or not should be irrelevant. This is plain awful Customer Service no matter how you spin it. Their policy of regarding digital the same as physical downloads is simply backward and is a very difficult stance from a customer viewpoint in this day and age.

Whatever the next Nintendo console is this should be the very first thing that changes, ideally sooner but I guess the odds of that happening are slim.

To put it in to context every mobile phone company will give you a replacement with a crime number I don't see why a digital purchase should be treat differently he proved he bought it they have the records of purchase on his NNID no only that if he registered his new one time only code for his 3ds it proves purchase. I would sent them a freedom of information request to get my details and make them give it back alternatively buy bollock all from them again or used only.

Buy a DS Lite and an R4 card and download every Nintendo made game and enjoy them all A LOT until you feel like you've been suitably reimbursed.

These companies should be called to order. You can't provide something in digital only format, that I'm not allowed to back up AND not provide a way for me to obtain that item again (for free) in the case of loss. I bet an insurance company won't pay out on the nloss of digital media either. Anyone know if they will? Would be very interested to know.
