I'm sure Apple probably could replace it, but by the time it goes, you'd probably want to buy a new player anyway.

My missus ordered a black one of these beauties yesterday and is so excited about it aint right. am planning on ordering one end of month when get paid cause they do look the bollocks. Cant wait to see hers and confirm my interest.

I did check a couple of big stores locally (Edinburgh) at the weekend who didn't have any stock, hence the Apple Store order. Was pleasantly surprised by how quickly it arrived from them.
The great thing about iPods is that, like other Apple kit, they hold their value and there's a very strong secondhand market for them on eBay. So you can have one for a while, then sell it on and not lose too much money on it. Their warranty replacement policy is also excellent, so that's one reason I stick with them.

I have since hacked the firmware on the 3rd gen, removing the volume cap though I still end up having it a few notches below max volume before I'm satisfied. I recently bought a shuffle from the US which isn't capped and I can quite happily have that on half volume, sometimes less if I'm in a quiet room etc.
If the nano doesn't have the cap then I'll quite happily eBay my shuffle and get a nano instead.
