I'd file a complaint via PayPal as soon as possible to be honest. I'm not sure if you have to wait 7 days or something to do it though?

I'll just keep the stick for now and inform them if that's the case, i don't wana be without a memory stick for ages(got no money for a while

If you are buying something from them then you enter into a legal contract to exchange money/items. If they are not upholding their side of the contract by not giving you what you agreed to pay for then yes it is.
That's without even mentioning that they are selling unlicensed memory sticks. All memory sticks need to be licensed and must comply with the Magic Gate requirements to do that.

I bought a Sony 4mb stick from Ebuyer (a reputable online store) and on my PSP it says Magicgate "unknown". Maybe because I'm running a hacked firmware (Dark Alex's 3.40-OE).
Edit: according to this my one is fake! I have the simple round seals.

Sorry, not the really old memory sticks but all Pro sticks must be licensed and contain the MagicGate MagicGate chipset to be official.
I'm running m33-4 so it should still say that. Are you checking it on your PSP? Some older memory stick readers (Usually 3rd party but not always) aren't able to test for the Magicgate chip.
That's usually taken care of by a firmware/driver update for whatever is reading it though.
EDIT:
I don't think I'd buy one off eBay now to be honest, the place is full of fakes.
