Four times today, two of which I realised later were the same seller, I've gone to place a late bid and been confronted by the Sellers Paypal requirements are not met because I don't have an eBay account /bank linked one. This is something I refuse to do for several reasons but mainly because it should not be necessary if you're paying Paypal via credit card as I do.
It might just be an error on their part, Its happened to me before. If you message them you can get them to exempt you from the requirements.

Need some advice please guys. Recently sold a genuine Dunhill belt on eBay that the buyer is claiming to be fake, which it certainly is not. He wants to return it for a refund. This will happen over my dead body. I told him to take it to any Dunhill store for verification. Where do I stand?

If it's genuine I'd agree with you, he needs to prove that it's fake - he's probably just got buyers remorse and is trying it on.

Not sure what eBay will do though. Not much in my experience. You need to be careful though because you can't leave bad feedback for him, yet he's free to do it for you.

Thanks for the response. He's trying it on for sure as I know it's genuine, that or he dosent know what he's talking about which wouldn't suprise me.

He's probably claiming it's fake because he has a fake and will return the fake to you, and keep the real one for himself. Cynical? Perhaps, but I know that's happened to some people. Ask him to return it but be very, very careful to check what you get back to make sure it is the one you sent.

Thanks for the heads up. I'm not letting him return it though. Ill be taking a very hard line on this issue. We'll see what happens.

I believe eBay insists returns are mandatory now and that claims of "no returns" are invalid, but yeah... we'll see what transpires.

I still think you're within your rights to ask him to prove the item you sent to him is fake though.

Not really eBay, but I sold a bunch of DS Lite spares on another forum and marked them sold-as-seen, I always sell things of that nature like that as there could be problems with installation and whatnot. One buyer bought a DS Lite that had touchscreen problems but when he received it he said it wouldn't turn on and wanted to send it back, but it turned on before I sent it to him. He wanted a refund but I managed to convince him to leave it charging for a while to see, and he did and it eventually turned on and he hasn't emailed since to say there were any issues. I clearly stated that my parts should be used for repairs and not as gifts for family members (he bought it for his niece or something).

I was going to offer to refund him as I didn't want to get on the board's bad side and because the board mentions a returns procedure without any ifs and buts, but it really does seem that advertising things as-is and sold-as-seen is legally irrelevant if you come across a non-related issue (e.g. in his case it wouldn't turn on but I hadn't realised that issue while I had it). I'll simply have to step up my game and really, properly describe things not only to the best of my ability, but to make sure whoever buys them doesn't find something else wrong with them. I did sell a job lot of ipod bits a few years ago on that forum that weren't sold-as-seen (I was curious about possible returns rates) and had no problems at all.

I'll probably start marking higher-value items, too, in a way that makes them distinguishable (Where possible, I log the serial numbers on an Excel sheet along with the relevant buyer info already), and take lots of photos.

It makes me wonder where we stand as sellers, though. I've never had an item I've sold returned to me, but what happens if an issue arises that we didn't know about? For all I know, none of my stuff's been returned because the buyers simply assumed they couldn't return used goods. Suppose I sold a TV that's been working fine according to me, but someone buys it and finds a certain feature I never used doesn't work (e.g. built-in Freeview tuner), was I simply expected to test out all functions before selling? I doubt putting 'Freeview tuner untested, otherwise fine' isn't enough, or is it? I suppose I could nip it in the bud and claim any features I didn't try are NOT working, which would mean if the buyer found them to work then it would be a bonus for them, but if not then the item is still within the limits of being 'as described', although that would probably severely affect the final sale price.

**** has opened a dispute with ebay never selling on eBay again after this can they chase me for the money if I close my paypal account? This **** will never get a penny from me if they find in his favor. Is the onus on me to prove it's genuine ( which I can't, but it is) or vise versa?

Ask him to return it if he thinks it's fake... his response might be telling.

He's happy to return it, and claims to have been to a Dunhill store and was told it's fake. I know this is a lie as I bought it at a Dunhill store. I said provide proof it's fake and I'll refund as I know that isn't possible. What eBay will say who knows?

eBay will always side with the buyer. My recent difficulties were only remedied when I threatened police involvement and a lawsuit unless they actually started to listen to me in regards to how what the buyer was saying was not scientifically possible.

They don't need to chase you. If you refuse to pay they'll just take the money straight out of your bank account.

I'm very wary of selling items now.

Bought an AGP 3D card (yes my pc is old) from a seller, soon as I recieved it I was worried.
Rattling from box didn't sound good, opend it up. Ahh not to worry the 3D card is in it anti static bag which is wrapped up in toilet paper.......WTF!?
Whack it in PC No. 2 first (the new PC) lines on BIOS hmm that reminds me of something (my old PC 3D card that died had same issue) 800x600 res, grab drivers, install new drivers, reboot.....nothing constantly reboots and doesn't load past Windows 7 logo. GREAT.
Screw it will try it in PC No. 1 the old PC, long story short exact same thing.
Now what's more annoying is that I now have to email the guy and say Sorry bud but your 3D card is NO WORKING! I expect crap back, I will then have to explain he packaged a 3D Card in it's original box wrapped in a (bin bag?) with tissue paper to protect the 3D card, wise move. See what he screams back NO DOUBT and then have to involve paypal, I end up getting my cash back (hopefully) Sending him his F***ED card with a note which can be the moral of the tale (alongside my squashed GBA games recently.)
NEXT TIME PACKAGE YOU F****** STUFF WELL YOU STUPID MOTHERF*****, SERIOUSLY!
I think this will be the last time I buy from ebay.
                              Rant over.

Ebay require a letter from a reputable store (headed paper with phone number) stating that they have seen the item and that they confirm it is fake, otherwise they will do nothing.

So unless he has this letter in that format and has sent it to ebay the case should be closed.

Well that is their policy, whether they act on it in all cases is another matter.
