Just had a quick look at the case and there are tiny tell-tale signs it has been opened. Fu*k. The irony is I only removed the plastic cover, I didn't open the inner metal casing and fiddle with the components so the console poses no threat to a repair engineer. I don't suppose they'll take that into consideration though.
If they do return it unrepaired, will they still charge me for their time and the courier service? Don't really wanna throw any money away if I need to buy a new console.

Following the advice in this thread I decided against sending my 360 to Microsoft and sent it to a guy on eBay instead who, for ?28.50, not only repaired the console but modified the cooling arrangement to increase air flow and heat expulsion and so help avoid future problems caused by overheating - all covered by 6 months warranty.
Sent the console away on Monday and got it back today all fixed. Seems a fair bit quieter that it was and using the guide is definately quicker.

I received my 360 back from Microsoft on Tuesday. Apparently it had the motherboard replaced. I played a couple of hours of Lost Planet and a little more the next night and all was well. I tried to play Ridge Racer 6 tonight and it locked up whilst loading an online race. I had to switch it off, then on again to be greeted by the Ring of Death. Powered off again and we're back to green. Ten minutes later, same thing. Power cycle and after another daliance with the ROD it's green again. I've booted Gears twice now and the first time it locked up, although it's currently running fine, and has been for the last 20 minutes.
I rang Microsoft and they want me to send it back. They refuse to give me a new machine and openly acknowledge that I'll get a refurb, "as per the agreement I entered into when I bought the machine". Funny I don't remember reading or agreeing to any such agreement when I clicked the 'buy' button on play.com in December. Apparently it was also my fault that I couldn't speak to a supervisor. I should have known to call before 6pm because after that the management all go home and leave the grunts to 'run' the place.
I think I'm going to try the same people Charlie did because I'll get my remaining 6 months warranty via them instead, and they at least appear to do something other than chuck the same flawed components in again. Badly.

Consumer Rights Help needed please!
I bought my 360 from Play.com in December 2006. It failed last month and has just come back from MS after three weeks. It's already failed again, so I'm faced with having to return it *again*.
Anyway, IIRC my contract is with the retailer, not the manufacturer and therefore play.com are obligated to replace it.
So I rang Play and they reckon that after 28 days I have to go via Microsoft (and were really rude with it). They say that their Terms and Conditions state this (which they very roughly do) and so this is perfectly legal.
However, according to the DTI, no retailer imposed conditions override my rights under the Sale of Goods Act.
I've tried ringing my local trading standards, but the phone is on divert to the fax machine.
Has anyone here managed to get their retailer to swap the unit over in these circumstances. I know that Game used to say they covered stuff for 28 days, but this might have changed now. I really have no confidence in MS and can't be doing with having to wait 3 weeks for another shody repair.
