Perhaps ring him up etc, chase up a bit more before writing them off for non payment..

Was it an auction? If so they are legally obliged to pay. If I sold such an expensive item and someone messed me about, I'd be rather annoyed to say the least. In fact I'd love to see you threaten the seller with court (i.e. something online like moneyclaim - surprisingly easy to use so I've heard..)

Just a quick PayPal question - if I sell goods (not on eBay) and receive my PayPal payment via a credit card, is it normal for it to take a few days longer to show up in my account?
If someone pays with a credit card it should be an instant payment. The only time it takes a long time for the money to show in your account is if the person sending the money has a bank account on their paypal account, and they send an 'e-cheque' which takes 10 days or more to clear, until then you don't have the money, and until it's cleared it can be reversed quite easily.. you should know if its an e-cheque you've been sent as the email you get from paypal letting you know a payment has been received will say so, and in the recent history when you log into your paypal account it will show the status as 'uncleared' if you click on details, it will state the expected clearing date (allthough ive known it to take in excess of two weeks or more.. sometimes even not clearing until I contact the person and ask them whats going on!)

PayPal to PayPal should be instantaneous, even if they're using a credit card to fund the transfer as it will just go through on their account like any other credit card transaction. So as soon as they make the payment to you, you'll get it.

Yeah it should be an instant jobby if its PP to PP or by Credit Card. Must be an e-chq. Check your emails for the payment & all should explained in there & on eBay. You can also check your PP account too just to be on the safe side. Even when you get an email from PP saying its cleared check your PP account to be sure.

Watchout for buyers using someone elses Credit Card to pay too. If the CC holder doesnt know its been used or its been stolen & used you could be in the **** as it can also be reversed as a fraudulent payment even up to 14 days after it was used, & by which time u will have posted out the item. So u could possibly be out of pocket (if u havent followed PP's strict rules) & they've got summat for free.
Whatever you do do NOT send anything until it has cleared.

I might do this as I'm slightly annoyed about this whole thing the more I think about it. Will be interesting to see what happens. Moneyclaim? I'll check them out.

Bought a pair of headphones from Canada on ebay. The package shouldn't be too large but they're worth about $100, am I likely to get hit by customs even if marked as a gift?

And, now this is possibly a stupid q I know, but, the chap is asking quite a lot for insurance, and i'm a bit worried that if I do refuse it, he could quite easilly not send the item, or the item could get lost of course. Nothing I can do about this is there?

It being marked as a gift does not exempt it from being taxable. It merely raises the top threshold for it not being taxable slightly. A $100 item will still be taxed; however, it depends on how he is sending it. If by airmail, you'll probably get away with it. If it's by courier, good luck, expect to pay 21% plus a handling fee on top (avoid EMS i.e. USPS Express Mail, switches to Parcel Force in this country, they're **** and they charge a ridiculous £15 handling fee).

Hmm.. yep, actually Tommy I think that a buyer can do a CC chargeback months even, after the item has been sent.. unfortunately it's one of those things that can happen when using Paypal.. I haven't had a chargeback particuarly long after receiving a payment, but I have definitely heard of it happening..

What sort of video games? I know Genki Video Games accept Paypal, great service and good choice too, really know their stuff.

Yeah, you can probably find plenty of info. on putting a case together by using google. A good site is the consumer action group forums (google it). Im certain that goods purchased on online auction must legally be paid for.. so you may have a good case (however im not an expert, and I haven't tried moneyclaim personally !)

Can anyone help me with this eBay purchase problem?

I know ebay has it's own thread but I wanted this to get seen sooner rather than later because I think it might get ugly...

So I bought a 20GB iPod from ebay, it took 8 days to arrive (despite me paying for parcelforce 48 delivery, they didn't post it until 6 days after I paid).

It was fine at first, but today it stopped working. I tried everything apple.com/support/ipod says to try and basically it's ****ed.

I've emailed the seller (justdeals.co.uk)...they have pretty good feedback though a lot of people moan about delivery speeds (no biggie, so long as it works y'know).

But they are SO slow replying to emails and I'm ****ing fuming right now. I sent an email at lunch and I've had no reply, but they were quick enough to take my money. I've now decided "**** them", I don't want a replacement, I want a refund.

However, in their T&C's they state :
"Refunds will only be issued if a replacement is not available"
Surely that isn't right? My right at a consumer is to a refund with faulty goods isn't it?

                        Furthermore they also state :
"Returns may be subject to a 15% restocking fee"
Excuse me, what the ****? What right to they have to do that? I'm no legal expert but I'm SURE they can't charge ME for supplying me with faulty goods? Especially since they themselves offer a 30 day warranty!?!

                        Link to the auction :

Link to their website (NO CONTACT NUMBER, ONLY EMAIL!!) t&c's :

I'm not expecting this to be peaceful nor easy, so what are my options?

I paid via paypal...I don't think this justdeals company is going to refund me...

                        What can I do?

I'm absolutely fuming and exhausted and I'm pretty sure I've been done here, but I need help working out if there's anything I can do.

                        Cheers.

Just tell em its faulty and you want a refund your entitled to that. If you paid with paypal with your credit card tell them as their liable just as much as they have lent you the money for faulty goods. You might want to contact Paypal as well because the funds are in the paypal account (but they can take ages) its always easier just to get onto credit card first if their draggin their heels. They will investigage on your behalf and probably just recind the funds. They cant charge you restock fees etc.. for a faulty item!!!

I paid with paypal it was half money in the paypal account, half credit card payment.

I thought that about the restock fee, didn't spot that at first when buying but I was DISGUSTED to read that.

Because they've put that in their terms and conditions though, by buying it I accept them don't I? But SURELY they cannot refuse me a refund on faulty goods?

How do I go about getting the money back then with paypal/credit card. Do I ring my CC company and explain the situation, tell them the seller refuses to refund etc? I've never had this kind of thing happen before, I'm usually extremely careful.

Are iPods generally **** by the way, cos I was thinking about just hittin Amazon for one of the new ones soon, so at least I've got something to listen to music on

If I remember theres a complain category on paypal for the goods being broken/damaged. In my experience (unfortunately) these sellers respond a lot quicker when you threaten their source of income.

Hey Jebus, from doing a whois on their domain name (justdeals.co.uk) it seems that they are a US company? Their telephone number is listed as 510-441-6490. If you have Skype, and SkypeOut, you can call that number very cheaply.. otherwise its not much use.

Was the iPod advertised on eBay.co.uk and priced in GBP? If so, you should be covered by UK consumer laws.

What did you say to them? if the goods were faulty upon arrival, you are within your rights to request a full refund, and they also have to pay the return carriage for the faulty goods. If you told them about using it for a few days and then it failed.. im not sure whether they can say refund only if replacement isnt available or not..

You're probably best off contacting Consumer Direct for some advice. Check out www.saynoto0870.com for a number for them (number varies depending on what region of the UK your in).

I know for a fact that if you file "SNAD" (Significantly Not As Described) through paypal you'll probably get nowhere.. its a shame it wasn't all on your CC. Basically I'd read up on your rights on trading standards website and quote some consumer acts etc, show them you mean business..
