      Sorry to say this but u havent got a leg to stand on mate.
      Explain to the buyer that u have to make a claim in order to make sure that RM havent misplaced it & that it could about a month for RM to fully investigate. If the buyer files a dispute for a refund in the meantime then let it run the full course as PP will eventually automatically give a refund, but at least u may during that time get an answer as to wether the buyer was bull****ting u over the lost item or not.
      HOWEVER, if u havent got a tracked method to prove to PP its been delivered then u have no hope. All u can do is threaten the buyer with the Police & claim that a fraudulent activity has taken place. It wont mean **** but perhaps it'll scare the **** out of him enough to pay up.

      I'm about to do this myself but because a buyer paid using PP but it turned out to be a fraudulent method i.e. some elses credit card, & he's been constantly telling me he's sending payment via another method, but I've finally had enough.

      By the way, I'm (unfotunatley) an expert when it comes to lost items & fraudulent buyers.

        No tracking, so like you say I'm pretty much screwed. The paypal refund system is so heavily in favor of the buyer that I'm seriously considering not selling anything else through them. If the buyer hasn't paid for a recorded delivery method (which I gave as a option), then to me it should be them who is liable if the item is posted, but doesn't arrive. I've had this once before and just ended up paying the refund, but I'm half tempted to write to my bank to cancel the direct debit activity from Paypal, change my card details to something that doesn't exist and just refuse to pay. I know this guy is lying just by the language he used in his messages before he escalated to a claim. It may only be a tenner but it's still money wasted so I am intending to fight it until the end.

          I totally know how u feel mate, however, I know this is gonna sound harsh but if u gave the option for the buyer to choose reg postage aswell as trackable methods then by eBay's rules its u thats taken the risk by offering it.
          I send everything by Recorded or 'International Signed For' Delivery now because from my recent experience there are more & more dodgy buyers on eBay than ever. As u said u can usually tell who is bull****ting u with their emails, but I think more & more are realising that they can pull this **** & that u havent got a hope in hell. And if theres more dodgy buyers around then the odds of u getting a dodgy buyer are rising & it really is better to be safe. Also make sure that u only send it to the address in the Paypal invoice u got. DO NOT SEND IT TO ANOTHER ADDRESS IF THE BUYER ASKS!. If u send it to an address other than the 1 specified in the PP invoice then you're not covered.

          By the way, in the past 3 months I've had to make 5 Lost item claims & 2 buyers have paid using a fraudulent card. So far I've lost £100 because of all this **** & I cant afford to lost that kind of money.

          What with buyers being favoured to sellers & their new FVF price hikes eBay are gonna lose a lot of trade, & I'm just waiting for someone to offer a new auction site to cash in on eBays loss.

            I've currently got someone trying to claim for a "significantly not as described" as he's trying to play a USA mod-protected ps1 game on a modded ps2.

            He won the auction, left positive feedback upon receiving/checking the item then realised 2 days later it won't work in his modded ps2. Wants a full refund which i've declined as everything was tested before dispatch (both in US PS1 and in ISO format which I have proof of). After being declined the disc now apparently has damage etc

            Like normal ebay will side with the buyer regardless of positive feedback already being left on his part but it's all good. With the proof I already have they've already stated they will class it as a fradulant claim thanks to the positive feedback etc.

            Just need to wait for claims to more than likely side with the buyer, buyer gets refund then a seperate department will deal with the fradulent claims aspect. From what i've already read if they find it to be a fradulent claim (The most important thing being that postive feedback has already been left) then their paypal account gets closed with any corresponding Ebay account too.

            Meanwhile i've already got my letter to the FBS ready

                  If its only a tenner fill out a claims form with Royal Mail or do it online, is it really worth the hassle fighting that out and being banned from using paypal for life?

                  Maybe you suspect he is lying, but unless you can prove it without a shadow of a doubt..? The seller is responsible for safe delivery of the item, paypals seller protection policy wont cover you unless you send to a confirmed address via a recorded method.. if something goes missing you have to take the hit.. you take the risk..

                  Send your proof of postage to Royal Mail and let them pay your ?10 back. Claim for the postage as well. It does take a month or two but eventually you'll get satisfaction. Block the person from bidding on your items again..

                  Don't mean to sound like a prick, but ive had a few claims in my time and unfortunately this is the risk of selling on eBay and accepting paypal..

                      Not worth fighting out because you'll get no where, but make sure u do make a claim for this money. In my eyes ?10 IS worth the hassle of claiming back. If he hasnt filed an 'Item Not Received' dispute thru PP then fill out a Royal Mail Lost claims form NOW before he does file a dispute & the chances of u getting a result b4 PP refund automatically might happen. If he was bulling u then u can prove it. If he wasnt then u got your money back & can send the refund.

                      U wont get the postage cost back. I've made so many claims by Reg postage & Recorded postage & included the postage cost in the loss & have NEVER received the postage cost back.

                      So in theory u will be out of pocket slightly unless u only refund the cost of the item. But that means you'll probably still get a neg & the buyer can probably still file a dispute for not getting all their money back.

                      Being a seller just doesnt seem worth it anymore

                              If you get the one fron allcam.biz (on ebay or their own page),
                              you get 12 months warrenty from them.
                              Obviously VC content will be gone.
