I ask because i just bought something from a USA eBay seller & paid by PP, during which I could opt in/out of insurance. I decided to opt out because stuff has arrived with no probs in the past.
But if summat goes wrong & the seller says "tough **** u didnt take out insurance", then can I file a dispute & get my money back?
to be honest i guess you could

but here i have a moral issue, if you knowingly decide that you dont want insurance and then cry if it doenst turn up - thats your problem imo

i've had a few things shipped from abroad and as long as they can jpeg me proof the item was posted i'm happy, but its always arrived anyway

thats the main reason why i force insurance on people in my terms and conditions

I totally agree with u mate. But if other people are gonna go blubbing, file a dispute with PP or take me for a ride when it comes to not getting an item insured & it gets lost then I dont see why I shouldnt do the same.

If this rule (that I hadnt heard of until I got stung on more than 1 ocassion!) hadnt been set out by eBay then I'd hold my hand up & say "Fair enough mate. I took the risk, its my own fault".

But as this is now the rule then I dont see why I should have to suffer as both a seller & a buyer.

i'm not blaming you old chap and i can understand and its upto you

but you are just lowering yourself to their level and doing exactly what they did to you - just hope you complain about yourself in the same way here when it happens

always always force insurance on the buyer as it helps in the long run, wrt forums and guys i know, i'm happy to send via which ever method they want as i know if they tell me it hasnt appeared, i know it hasnt appeared - but on ebay - totally different

and me sending stuff only 4 parcels have went walkies and me receiving stuff its about 9 i think, most of them were from yes-asia for some reason

This **** HAS already happened to me as a seller on more than 1 ocassion & thats why I dont see why I shouldnt gain from it too as a buyer.

              I've said it b4 & I'll say it again:

If eBay didnt allow this **** to happen in the 1st place then I wouldnt be taking advantage of it myself. If it's 'lowering yourself to their level' then consider me lowered, but only because eBay & Paypal have allowed me to do so & because they are money grabbing twats who need to have an equal balance for both sellers & buyers, not just for buyers.

Buyers should have to tick a box or summat before they agree to buy stating that if they choose a non trackable postage method then they take the risk of not receiving the item & will not receive a refund.

It would have worked for me!

Is it possible to get my money refunded on an item if the seller is no longer a registered ebay user? I started a claim against toysonlinehk and now ive been told there no longer registered with ebay.

Buyerclaims the item was 'damaged' when he got it???

Okay I got an email from a buyer who said he got the game but the disc was cracked & that he either wanted an exchange or refund. The game I sold was Factory Sealed.
I told him to send it back.
I got it back to discover that although it was cracked that there was also a lot of finger marks & light scratches on the disc, which to me would indicate that he'd man handled the disc a bit & been able to play it.
Now I dont know if he's playing a fast one or summat but it all smells a bit dodgy to me.

What should I do? I also stated in my auction that I would accept damaged items back providing that they arrived as sold (in this case complete and looking as new except for the crack of course!!).

Tell him the score, offer him a partial refund. Sit tight and wait to see if he accepts that, otherwise you may have a paypal claim on your hands. You have grounds to win this dispute if you tell them what you've told us.

Don't get into a slanging match. If the guy is emailing you, being rude and using txt spk like an idiot this is the way to go as they are SO HORRIBLE to deal with.

wen i recievd it it was cracked and broke. game duznt work i want a refund.

JUST SHUT UP AND WRITE PROPERLY YOU IDIOT.

I've asked the buyer if he's played the game while it was like this to see what answer I get.

Here's some pics of the discs condition so u can see what I mean:

I've got some nutjob who's made a claim on paypal saying he never rec'd even though I've got trackign which shows he's signed for it.

I wouldn't say they're a nutjob, either something has gone wrong their end such as their neighbour nicking it (unlikely but possible) or the person is simply a scammer. What was the item? Hopefully PP will do the right thing as you're clearly not at fault but you never know with them.

We all know what Ebay and paypal are like though. If he puts a claim in he is most likely to win it because thats how they work. The sellers pay all the fees and the buyers get all the protection. It stinks but we still use it.

These days I only ever list stuff when they've got a special listings day running, & every time I list stuff I get someone either trying to rip me off with a dodgy claim or fraudulent PP payment by card or they win the item & then dont pay up.

I've really lost faith in buyers on eBay. It never used to be like this until about 2 yrs ago. The problem is that until another popular auction listing site appears its still the only & best option.

Anyway, what do u guys think of the pics I posted?

Nah, nowadays they screw the buyer AND the seller. I've been waiting weeks for some stuff I paid 25 Euros for through Paypal, and eventually had to file a claim as the guy refuses to even tell me if he has posted the stuff or not. Anyway, Paypal says that they will refund whatever they can recover - minus a $25 processing fee. In other words, if the guy has no money in his Paypal account then I'll get nothing at all - and if he does have money in the account, the maximum I'll get back is about a quid's worth.
